Reversal of performance advertising actions are decided by the Advertiser governed by a max reversal percentage of 100%
Media Partner Tracking Pixel
Advertiser does NOT allow media partner to fire their tracking pixel when the consumer action is completed.
AQUART AFFILIATE PROGRAM TERMS & CONDITIONS
Please read these terms and conditions before joining our affiliate program or begin marketing our products. These terms and conditions are written to be understandable, but if you have any questions, please contact us. By becoming an affiliate, you will be agreeing to be bound by these terms and conditions, so please read them carefully and do ask questions if there is anything that is not clear to you. Also, as an affiliate you will be responsible for assuring that all your employees, agents and members understand and comply with these terms and conditions.
DEFINITIONS:
The following definitions apply: (i) “we”, “us”, or “our” means AQUART and its websites www.aquartonline.com (ii) “you” or “your” refers to you and your website(s) linked to our website; (iii) “Program” refers to our affiliate program.
ENROLLMENT & COMMISSION:
After you submit your application, we will review it and your website(s) and notify you of your acceptance or rejection into our Program. Include in your application all websites you will use. Please allow up to 72 hours for your application to be processed. We reserve the right to reject your application. If you receive a rejection and feel we have made an error, please contact us. If accepted, you will be enrolled in our Program. Enrollment in our Program will entitle you to receive up to a 10% commission on all sales from our website by customers who are referred to our website from a link on your website(s) that we provided to you, subject to your compliance with the terms and conditions stated below. If these sales exceed $20,000 (net of customer returns) in any given month, you may be eligible for a future commission increase. If you believe you may be eligible for such a commission increase, please contact us.
LINKING TO OUR WEBSITE:
When you are enrolled in the Program, we will provide links to you through the affiliate interface. Your application which has been accepted and your use of these links mean you agree to comply with and to be bound by the following. You shall ONLY use linking code obtained from the affiliate interface and you shall not manipulate that code. You shall ONLY use links made available to you on your domains listed in your application. Your website(s) shall NOT in any way copy, resemble, or mirror the look and feel of our website. You shall not use any means to create the impression that your website is our website or any part of our website including, without limitation, framing of our website in any manner. You shall NOT engage in cookie stuffing or include pop-ups, false or misleading links on your website. In addition, wherever possible, you shall NOT attempt to mask the referring URL information (i.e., the page from where the click is originating). You shall NOT use redirects to bounce a click off of a domain from which the click did not originate in order to give the appearance that it came from that domain. This does not include using “out” redirects from the same domain where the affiliate link is placed. If you violate any of the above, you will forfeit your past and current commissions and your commission will be set to 0% until the violation is corrected.
WEBSITE RESTRICTIONS:
Your participating website(s) may NOT: (i) Infringe on our or any anyone else’s intellectual property, publicity, privacy or other rights. (ii) Violate any law, rule or regulation. (iii) Make any false, deceptive or unfair claims. (iv) Contain any content that is threatening, harassing, defamatory, obscene, harmful to minors. (v) Contain nudity, pornography or sexually explicit materials. (vi) Contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, interfere with, surreptitiously intercept or expropriate any system, data, or personal information. (vii) Contain software or use technology that attempts to intercept, divert or redirect Internet traffic to or from any other website, or that potentially enables the diversion of affiliate commissions from another website.
DOMAIN NAMES:
Use of any of our trademark-related terms as part of the domain or subdomain for your website is strictly prohibited. Any violation will result in cancellation of your enrollment in the Program. Prohibited trademarked-related terms include, but are not limited to: AQUART, IKT, VECYS, aquartonline.com, VECYS Ice Maker, VECYS Car Refrigerator, IKT Ice Maker, IKT Car Refrigerator, and any/all closely related variations or misspellings.
TRADEMARKS:
Use of AQUART, VECYS, IKT’s trademarks may be used in a manner as set forth herein: (i) You may only utilize the trademarks in the description of the videos and only in a format consistent with AQUART, VECYS, IKT’s trademark usage; (ii) You are required to use the appropriate descriptor after utilizing the trademark such as ™ or ® as provided by AQUART.
PPC RULES & GUIDELINES:
If you are enrolled in our Program and participate in paid search engine advertising or pay-per-click (“PPC”), you must adhere to our PPC rules and guidelines as follows: (i) You shall NOT bid on any of our trademark-related terms (which are identified below), including any variations or misspellings thereof for search or content-based campaigns on Google, Bing, Yahoo or any other keyword-based advertising network. (ii) You shall NOT use our trademark-related terms in sequence with any other keyword (i.e., "VECYS CAR REFRIGERATOR" or "IKT ICE MAKER sale"). (iii) You shall NOT use our trademark-related terms in your ad title, ad copy, display name or as the display URL. (iv) You shall NOT direct link to our website from any pay-per-click ad or use redirects that yield the same result. Others must be directed to an actual page on your website. (v) You shall NOT bid in any manner higher than ASMOKE for any search term in position 1-5 in any auction style pay-per-click advertising program. If you automate your PPC campaigns, it is your responsibility to exclude our trademarked terms from your program and we strongly suggest you add our trademark-related terms as negative keywords. We have a strict no tolerance policy on trademark-related violations. If you violate any of the above, you will forfeit your past and current commissions and your commission will be set to 0% until the violation is corrected.
SOCIAL ADVERTISING RULES & GUIDELINES:
If you are enrolled in our Program and participate in social advertising, you must adhere to our social advertising rules and guidelines as follows: (i)You ARE allowed to use your affiliate links on your own Facebook, Twitter, etc. pages. (ii) You shall NOT post your affiliate links on AQUART’s Facebook, Instagram, YouTube, Twitter, Pinterest, etc. company pages in an attempt to turn those links into affiliate sales. (iii) You shall NOT run Facebook ads with ASMOKE’s trademarked company name or related terms. (iv) You shall NOT target fans or followers of any of our social profiles (including, but not limited to, those identified below) including any variation or misspellings thereof for social campaigns including, but not limited to, Facebook, Instagram, YouTube, Twitter, LinkedIn, Pinterest or on any social network.

You shall NOT target trademark-related terms as interests (identified above), including any variation or misspellings thereof for social campaigns including, but not limited to Facebook, Twitter, Instagram, Pinterest or on any social network. (vi) You shall NOT use our trademark-related terms or logo in your ad creative, title, ad copy, display name, or as the display URL. (vii) You shall NOT direct link to our website from any social ads or use redirects that yield the same result. Users must be directed to an actual page on your website. If you violate any of the above, you will forfeit your past and current commissions and your commission will be set to 0% until the violation is corrected.
COUPON RULES & GUIDELINES:
If you are enrolled in our Program and your website promotes coupon codes, you must adhere to our coupon rules and guidelines as follows: (i)You may ONLY advertise coupon codes that are provided to you through the Program or that are displayed on our website. (ii) You shall NOT post any information about how to work around the requirements of a coupon/promotion (i.e., first time customers only). (iii) You shall ONLY display coupons in their entirety with the full offer, valid expiration date and code. (iv) You shall NOT use any technology that covers up the coupon code and generates the affiliate click by revealing the code(s). (v) You shall NOT advertise coupon codes obtained from our non-affiliate advertising, customer e-mails, paid search, social media, or any other campaign. (vi) You shall NOT give the appearance that any ongoing offer requires clicking from your website in order to redeem. Additionally, if your website ranks on the first page of Google for terms related to our website or company name(s) combined with the words coupon, coupons, coupon code, promo code, etc. and/or your conversion rate exceeds 20%, you may be given a lower commission than our standard rate to offset the reduced profitability of orders. The current rate is .5%. If you violate any of the above, you will forfeit your past and current commissions and your commission will be set to 0% until the violation is corrected.
COUPON ATTRIBUTION & AUTHENTICATION:
You will not be paid a commission for a transaction that utilizes a non-authorized, in-valid, phony or expired coupon code during purchase. We reserve the right to make the determination in our sole discretion of whether a coupon code used during a transaction is authorized, valid, authentic and useable. A commission will be paid for a transaction without use of a coupon code or with use of a coupon code we have determined to be authorized, valid, authentic and useable.
SUB-AFFILIATE NETWORKS:
Promoting AQUART through a sub-affiliate network is permitted. However, you must be completely transparent regarding where traffic from your sub-affiliates originated. You must ensure that all your sub-affiliates promoting AQUART adhere to our Program terms and conditions, and you must take commercially reasonable action to inform sub-affiliates of such terms and conditions. This includes, but is not limited to, restrictions on advertising through toolbars, browser extensions, and through any paid placements such as pay-per-click campaigns. You will not be paid a commission from sales made through any subaffiliate that does not comply with our Program terms and conditions.
AQUART REFERRAL PROGRAM:
You may not participate in the AQUART referral program or any other referral program AQUART may run by converting referral links into affiliate links. AQUART will not pay a commission and a referral bonus on the same sale.
MID-CHECKOUT COMMISSION REDUCTION & OVERWRITE RULE:
AQUART uses a dynamic pixel system that may make changes to the standard commission in the case of a mid-checkout referral, which is defined as a cookie that is set within the last ten minutes before purchase. By reducing the commission on these types of referrals and by closely monitoring the quality of traffic we receive from each affiliate, we will be able to pay out higher commissions for driving new customers and traffic. This also means that full credit will be given to the first referring affiliate in the case that a second affiliate enters within the last ten minutes. For example: Two affiliates outside of ten minutes before sale, "last in" logic applies. One affiliate outside of and one within ten minutes before sale, "last in" affiliate will receive a reduced commission of 2% and first affiliate will receive full commission. Single affiliate within ten minutes before sale, 2% commission will apply. Two affiliates within ten minutes before sale, “last in” affiliate will receive a reduced commission of 2%.
TRANSACTION-LOCK DATES:
All sales will remain in a “sales pending period” and will not lock until 45 days following the date of transaction. All commissions owed to you after the lockdates will be paid to your partner account. Commissions will not be paid until the next month for which total commissions are $0.01 or more. For example, for a transaction that occurs on July 1, the sale will lock in October and the funds would be released in November as long as total commissions are $0.01 or more.
ADVERTISING & PUBLICITY:
You shall NOT create, publish, distribute, or print any written material that makes reference to our Program without first submitting that material to us and receiving our prior written consent. If you intend to promote our Program via e-mail campaigns, you must adhere to the following: You must abide by the CAN-SPAM Act of 2003 (Public Law No. 108-187) with respect to our Program. The e-mail must be sent on your behalf and must not imply that the e-mail is being sent on behalf of AQUART. The e-mail must first be submitted to us for approval prior to being sent or we must be sent a copy of the e-mail.
OPERATIONS OUTSIDE UNITED STATES:
If you are conducting business or taking orders from persons in other countries, you shall follow the laws of those countries. For example, you shall comply with the European Union’s then current privacy law (e.g. Privacy and Electronic Communications Directive or the General Data Protection Regulation) if you are conducting business or taking orders from persons in one or more of the European Union countries. You also at all times shall comply with all United States export laws and regulations governing the sale and delivery of products abroad.
REVERSAL & COMMUNICATION POLICY:
In order to maintain our very low reversal rate, we reserve the right to reverse orders due to order cancellations, duplicate tracking, returns, disputed charges, and Program violations as outlined in these terms and conditions. Additionally, if we ask you for clarification or more information on any orders or clicks that we suspect may be in violation of our terms and conditions, you shall respond in a timely and honest manner. Below are violations of our communications policy. (i) You are not forthcoming, intentionally vague or are found to be lying. (ii) You are not responsive within a reasonable time period or after multiple attempts to contact you using information in your profile. (iii) You cannot substantiate or validate the source of your traffic to our Program with clear and demonstrable proof. (iv) You are a member of our affiliate Program with both IP tracking and Cookie tracking and receive a commission for the same transaction in both networks. If any of the above violations occur, we reserve the right to reverse orders, set your commission to 0% or suspend you from the Program. We know that many violations are a result of automated processes; however, it is incumbent upon you to ensure that you have the appropriate checks and balances in place to proactively control your processes and adhere to our Program rules.
FTC DISCLOSURE REQUIREMENTS:
You shall include a disclosure statement within any and all pages, blog/posts, or social media posts where affiliate links for our Program are posted as an endorsement or review, and where it is not clear that the link is a paid advertisement. This disclosure statement should be clear and concise, stating that we are compensating you for your review or endorsement. If you received product for free from us or from the affiliate management team for review, this also must be clearly stated in your disclosure. The following are examples of policies you should adhere to with your disclosures, but it is your sole responsibility to assure compliance with all FTC requirements. Disclosures must be made as close as possible to the claims. Disclosures should be placed above the fold; scrolling should not be necessary to find the disclosure (e.g., the disclosure should be visible before the jump). Pop-up disclosures are prohibited. For more information about FTC disclosure requirements, please review the FTC's "Dot Com Disclosures" Guidelines and the FTC's Endorsement Guidelines at: http://www.ftc.gov/os/2013/03/130312dotcomdisclosures.pdf http://business.ftc.gov/advertising-and-marketing/endorsements If your disclosures are deemed by us or determined by the FTC to not be sufficient, we reserve the right to reverse orders, set your commission to 0% and suspend you from the Program.
PROHIBITION AGAINST SOLICITATION IN CERTAIN STATES:
You agree that your solicitation activities on behalf of AQUART shall be limited to only providing a link on your website to AQUART’s website IF you are a resident of any of the following states: Arkansas, Connecticut, Georgia, Illinois, Kansas, Maine, Michigan, Minnesota, Missouri, Nevada, New Jersey, New York, North Carolina, Ohio, Rhode Island, Tennessee, Vermont, Washington and any other state with laws that would render AQUART liable for collecting sales tax on all sales to customers in that state (hereinafter a “Non-Solicit State”). Therefore, as a condition of participation in the Program, you are prohibited from engaging in any solicitation activities in a Non-Solicit State intending to refer potential customers to AQUART, including, but not limited to: (i) distributing flyers, coupons, newsletters and other printed materials, or electronic equivalents of such materials; (ii) engaging in verbal solicitation, including in-person referrals or initiating telephone calls; and (iii) sending emails, text messages, blogs, microblogs or maintaining social network sites intended, directly or indirectly, to solicit or refer customers to ASMOKE. If you are a resident of a Non-Solicit State, you must provide ASMOKE with a written statement of compliance with this provision upon enrollment and on an annual basis (on each January 31). If you are not a resident of Non-Solicit State and hereafter become a resident of a Non-Solicit State, either by moving or by your state of residence changing its laws to place limits on solicitation, you must immediately provide a written statement of compliance. You agree to provide a written statement of compliance whenever requested and to cooperate by completing any form which may be required for tax purposes, including but not limited to statements or certifications regarding your activities. You acknowledge that tax laws are subject to change at any time and such changes may render you ineligible for continued participation in the Program. If you are an organization, club, or nonprofit group you shall maintain prominently on your website information alerting your members to the prohibition against solicitation activities in each Non-Solicit State as described above. If you fail to provide the required written statement of compliance, or if you have not complied with your obligations or fail to confirm your compliance or otherwise cooperate whenever you are requested to do so, AQUART will suspend you from the Program.
